Abstract English
This paper deals with one of the most important topics related to ensuring the application of justice in society, the type of justice for which judges and public prosecution officers are responsible. This paper aims to clarify and analyzes the theoretical, ethical values that are used by the judicial system: it first, analyzes the nature of these values, and second, it answers many familiar questions related to the above professions in relation to these practical-ethical values.This paper aims, then, to shed light on the great role played by the judicial system in establishing and maintaining justice in society, as well as the commitment of those in charge of it to the values of professional ethics and how these values are reflected inside and outside of their work. This paper provides also a rational explanation of the ethical rules practiced in this respective field, and compares them with other legal systems and different philosophical ideas.
الملخص العربي
يتناول هذا البحث موضوعًا من أهم الموضوعات المتعلقة بتأسيس و ضمان العدالة التي يعد القاضي و الادعاء العام مسئولاً عنها، فمتى ما صلح القاضي صلح القضاء، ومتى ما صلح القضاء صحت منظومة العدالة وانتشر العدل. يوضح هذا البحث القيم الأخلاقية النظرية التي ينبغي أن يلتزم بها رجال القضاء و الادعاء العام و ذلك من خلال تساؤل فلسفي عن ماهية هذه القيم و طبيعتها، كما يسعى للإجابة عن بعض التساؤلات المتعلقة بمهنة القضاء و القواعد الأخلاقية العملية التي يجب على العاملين بالادعاء العام ورجال القضاء الالتزام بها.يهدف هذا البحث بوجه عام إذن إلى تسليط الضوء على الدور الكبير الذي يمارسه القضاء في استقرار العدالة في المجتمع، و أهمية التزام القائمين عليه بأخلاقيات المهنة في ممارستهم لعملهم، و انعكاس ذلك على سلوكهم داخل العمل و خارجه. يحاول هذا البحث أيضا أن يقدم تفسيرا عقلانيا للقواعد الأخلاقية في مجال القضاء، و يقوم بالمقارنة بين هذه القواعد في النظم القانونية والأفكار الفلسفية المختلفة.
